The Tax Guy: Renting to Family Members Can Be Taxing

Submitted by Jermaine A. Southern, CPA

The Tax Guy - PhxSoul.com
The Tax Guy
One way to weather a soft residential selling market is to rent out your present home until the market improves.

Renting out a home that you own may result in a tax loss for you, even if the rental income is more than your operating costs. This is because you will be entitled to a depreciation deduction for your cost of the house (except for the portion allocated to the land). And many people turn to family members first, however, if your tenant is related to you special rules and limitations may apply. (For these purposes, "related" means spouse, child or grandchild, parent or grandparent, and siblings.)

Here's the tax picture:

If you rent a home to a relative who (1) uses it as his or her principal residence (that is, not just as a second or vacation home) for the year, and (2) it's rented at a fair rental (not at a discount), then no limitations apply. You can deduct all the normal rental expenses, even if they result in a rental loss for the year.

The problem arises if you set the rent below the fair rental value. Since this then becomes a rental property which you are treated as using personally, you would have to allocate the expenses between the personal and rental portions of the year. Even more seriously, however, since all of the rental days (at a bargain rate to a relative) are treated as personal days, the rental portion is zero. Thus, you would have to report all of the rent you receive in income, but none of your expenses for the home would be deductible (Actually, you would still be able to deduct the mortgage interest, and property taxes. These items are deductible even for non-rental homes on your Schedule A.).

Given the above, it is important to set the rent at a fair rate. Factors to look at include comparable rentals in the area, and making sure rent payments at least are covering monthly mortgage for property. Rent payments which do not cover the landlord’s basic expenses may be assumed to be under fair market value.

Greater Phoenix Urban League First-Time Homebuyer Seminars

How is your credit
If you will be a first-time homebuyer in the near future, it would be extremely beneficial for you to attend one of the Greater Phoenix Urban League's seminars.

L. Maurice Brundidge, Director of Homeownership, has been organizing these seminars for years - I attended one about three years ago - and I learned a great deal about the homebuying process.

Brundidge said the Greater Phoenix Urban League is trying to better educate the African American community on the homebuying process, especially during a time when many people are facing foreclosure  and in need of some type of assistance.

During the First-Time Homebuyer Seminars, you will learn the six steps potential home purchasers must know before purchasing a home:

  • Get your credit and finances in order
  • Get your credit in shape and improve your scores
  • Know what you can be pre-approved for before shopping for a home
  • Interview at least three realtors before hiring one
  • Purchase the home that is right for you
  • Read and understand all documents before signing

Please visit www.gphxul.org to find out about upcoming seminars.

TV Show about African American Life in Arizona? Would You Tune In?

Try Ask Sponsored Listings
As the creator of PhxSoul.com, I've been privileged to learn about NUMEROUS African American organizations and individuals who are really trying to make a difference here in Arizona!

I always wonder about the black people who say that there's nothing goin' on in Phoenix! I want to ask them, "Are you living in a cave?!!"

The African American Town Hall that took place on January 10 at Tanner Chapel AME Church highlighted a number of issues that are affecting our community and showed me that that there are hundreds, if not thousands of black people here who want to make Arizona a better place to live!

With the momentum that I'm seeing for black people in Arizona, I think it's time for us to develop and host a television show on African American culture and progress in Phoenix!

During the African American Town Hall, a number of problems were listed including poor education, insufficient family and health resources, violence/crime, incarceration and economics. They're all valid issues for our community!

However, I think POOR COMMUNICATION is one of the key problems we have in Arizona!

Yes, we have PhxSoul.com, the Arizona Informant, the Ebony Cactus, AzNoir, the Soul List, Arizona Black Pages to report our news and promote our organizations and businesses.

But for reasons unknown to me, a large portion of African Americans aren't interested in reading these mediums to find out what's goin' on in our community!

Why?

Maybe it takes too much time to read them? Maybe people don't know how to access these publications and Websites? Maybe people don't even know they exist? Maybe we're intimidated by the Internet and technology? Who knows ...

But there is ONE medium that can reach everyone!

TELEVISION!! Everybody watches TV!

I'd love to see a weekly 30-minute program that informs people about what's goin' on from an African American perspective in the Phoenix metro area! We've had these shows in the past (in fact I was a guest on one of these shows when I was a kid), but of course the TV programs fizzled out due to lack of support.

If we had an ENTERTAINING, INFORMATIVE local television show that made black people aware of our efforts, success stories, businesses, entertainment venues, community events and organizations, celebrities, pioneers, nightlife and planned projects, I think African Americans would tune in! I think black people are craving a convenient place to SEE information about our community and television is it!

Maybe I'm being foolish for not keeping this idea to myself - I could do the research, then I could be the host and make some serious change! I've been on television numerous times and really enjoy being in front of the camera.

However, I'm not really connected to local TV network industry anymore so I don't know how to put the wheels in motion for this idea. I don't mind proposing this idea to the public because I'm sure that we have somebody who works in the local media industry who can make this happen quickly!

We'd have to find a local channel and staff willing to support this effort, VIBRANT, ATTRACTIVE and INTERESTING hosts (male and female) and local corporations who would be excited about advertising on the show! The local channel would probably need to air each television show several times per week (repeats) to make sure that it gets exposed to a wider audience.

I'm curious peoples, what do you think about this idea? Is it something that could work here? Do we already have a similar television or radio program that I haven't heard about?

Mello Mello – Neo Soul Music in the Valley of the Sun

Submitted by Linda Fields, Production Manager for Mello Mello

Mello Mello

Creating a unique sound they say you can be “grown and sexy to young, hip and still maturing” to enjoy, the duo on their debut album tells An Abstract Love Story destined to touch hearts and minds everywhere. They were each experiencing their own up and down issues with romantic relationships while they were writing and recording the album; this leads to some deep, refreshing honesty that everyone can relate to as they sing and rap along with the fresh beats and melodies.

Though Mello Mello is releasing An Abstract Love Story as a whole project—and to really go deep into the experience of their musical narrative, it must be listened to in its entirety—an obvious first single would be “I Just Wanna Love U” which has a sexy, subliminal groove under the duo’s desire to do whatever it takes to make a woman know how they feel.

An Abstract Love Story completely reflects who we are simply by blending Xtravagant’s hip-hop with my R&B background,” says Reddy, who does all the vocal melodies and harmonies while his partner does the rapping.

Xtravagentways adds, “What’s most comfortable and natural for us is describing how we feel towards a woman. With me, it’s about communicating in a different way and expressing myself without getting too mushy.”

Local Entrepreneur Creates Benedire.com to Help Share God's Word

Visit Benedire.com Today!

I'm a big fan of people who utilize their passions to not only make their own lives better, but to also help make the world a better place.

I was recently introduced to a gentleman (thanks K.D.) who is accomplishing this feat, one product at a time!

Cleavon J. Blair is a young African American entrepreneur from the Valley of the Sun who has created Benedire.com, a Website that aims to share God’s Word with the public and His followers by finding fun and interesting ways of getting people to read scripture in the Bible.

Benedire.com offers a set of products (such as t-shirts and coffee mugs) that are very easy on the eyes and are sure to inspire others to crack open their Bibles and to not only read, but also find comfort in the Word of God.

Please take the time to read my "conversation" with Cleavon about Benedire.com ...

Q: What is the purpose of Benedire.com?

A: I like to call Benedire.com its own ministry, meaning its purpose is to bring people closer to Jesus Christ by offering God's Word to an interested public, it just so happens that God's Word appears on a t-shirt or a latte mug, and other products to come.

What I like about our products is that we share a verse from the Bible, but not the scripture itself.  We do this purposely as a way to try to get people to open their Bibles and read what the Word of God says.

Also, in Italian, the word benedire means "to bless; to request of God the bestowal of divine favor."  We want our products to represent a request of divine favor to others, to be a sort of blessing.  For example, a good friend of mine has a younger brother who felt that God wasn't in his corner and getting him the things he needed.  My friend sent his younger brother our Matthew 21:22 t-shirt and after receiving the shirt the younger brother called his older brother and thanked him for the shirt, but most importantly, he thanked his older brother for sending him a reminder of what God says, "If you believe, you will receive whatever you ask for in prayer." The younger brother had to have faith that what he needed would always be provided to him, and that it is his faith in the Lord that will get him what he needs, and he was wise enough to see that.  That, to me, is the purpose of Benedire.com…

Q: Why should people buy merchandise from Benedire.com?

A: I would love for people all across this country, the world even, to support Benedire.com.  Not just for the business side of it, but truly to share the Word of God with others.

To often people hide Christianity in their back pockets because society around us keeps telling us it is not ok to publicly support Christianity, as if it (Christianity) is offensive or something and I just don't believe in that.  It seems to be ok for people to support everything else that they believe in, and I personally want to publicly support Jesus Christ because I've been through a few things in my life.  Had it not been for Christ, I know I probably wouldn't be here today to reflect on my past.  In short, Christ "got a brotha through", and I am very thankful and grateful for God's Grace and Love, and I want to publicly acknowledge that, so that He knows my love and appreciation is REAL.  There are others who feel this way, so I want them to have a vehicle to do the same.

There are other vendors out there who have tons of products with Bible verses and scripture on them, and if consumers feel compelled to purchase from those vendors, then that is ok because at the end of the day, it is all about the words that appear on the products.  We, Benedire.com, just want to do our part, to offer products to consumers, Christians who might feel that they are underserved by other vendors or their products.  Our products don't overwhelm you with graphics and colors, etc, and that's the beauty of what we're doing.  We provide products that are simple, yet classy, with an emphasis on the true purpose – sharing God's Word.

Q: When did the Benedire.com concept first pop into your head and when did you begin selling the shirts?

A: 4 years ago, when I was living in Chicago, I wanted to purchase a shirt with some biblical scripture on it, but the shirts that I found were not to my liking.  The shirts I found were so loud with the prints that I couldn't find the scripture on them, which, in my opinion, totally negated the purpose of the shirt.  That day I told myself I would have a line of products that plainly and clearly stated God's Word; something simple, yet classy that could be worn whether a person was dressed up or dressed down.  In short, I wanted something that would state God's Words, but still allow me to "get my grown man on."

With life and everything else happening, it took 4 years to start selling our t-shirts. I mean, it was only last year (2006) that I started seriously looking for reputable, local printers and started ordering t-shirt samples.  We went through the design process earlier this year, which was somewhat tough, but a fun process in coming up with the design of the shirts, which led us to a quiet launch of this line of business on December 13, 2007.

Q: Is Benedire.com turning over a high number of sales?

A: As I stated earlier, Benedire.com was launched on December 13, 2007, which was just a few weeks ago. We have done no marketing at this point, and I'm proud to say that we've sold over 175 shirts and 30 latte mugs across the country.

While this isn't an extraordinary number of product sold compared to what some of the bigger retailers do, it is substantial to us because it gives us a sort of grass roots support of our products, which, to me, is a great way to launch a product because you have a genuine opportunity to build brand loyalty over the long term.

Now don't get me wrong, if we were to receive 1000 orders a day for the next 4 - 6 months, I would not be unhappy with that.

Q: How do you market your products to the public?

A: As I stated earlier, we haven't done any marketing with our Benedire.com products yet. Our marketing strategy and plan will kick into gear at the end of January 2008. We will be advertising in industry-specific magazines as well as sending collateral and product samples to several Christian organizations around the country.

In the very near future, we hope to license resellers (churches, Christian bookstores, etc.) to resell product for us.  Also, I would love for us to sell through a vehicle like Amazon.com, but we are too small for that at the moment, but we will definitely get there, and very soon…

Q: Do you have a home church in the Valley?

A: I attend First Institutional Baptist Church in Phoenix, AZ.

Q: Do any of your proceeds go to charities?

A: We have short-term and long-term donation goals for Benedire.com.

In the short-term, we will select a new organization each year for 3 years to donate a percentage of sales to.  This year, we've selected the St. John Missionary Baptist Church of Springfield, OH as the organization to receive our donations, of which will be distributed quarterly.

Long-term, we'd like to establish our own charitable organization of which we can donate funds to.  This organization will be used to directly help individuals, rather than us donating monies to a larger organization.  We want to be able to help people in a more definable way, such as, paying someone's mortgage for 3 – 6 months, or buying someone's groceries for a year, or making their car payment for a year.  Not necessarily taking the costs away forever, but giving a family or an individual an opportunity to "take a break" for a few months and possibly save a little extra money.  We are a couple of years away from doing this, but that is our goal…

Q: Can you tell us about your personal life?

A: Well, I'm a married father of one little girl, and I live in the Valley byway of Ohio (how 'bout those Buckeyes!!!).  I'm a graduate of Bowling Green State University (Go Falcons) in Bowling Green, OH with degrees in Business Administration and Computer Science.

As far as community service is concerned, all I've done is try to be a respectful member of society and help in ways that I'm able to.

I encourage you to visit Benedire.com and support Cleavon's efforts for success - in the businessworld and the community!
